At EverBright Solar, we prioritize the safety and protection of our customers and our business. We are fully insured through Maltings via Simply Business, ensuring comprehensive coverage for all aspects of our operations. Our Public Liability Insurance (PLI) provides peace of mind, covering up to £5 million in the unlikely event of accidental damage or injury. Additionally, we have Employer’s Liability Insurance (ELI) to protect both our team and clients, as well as a £250,000 Professional Indemnity Insurance (PII) policy. This ensures that every project we undertake is backed by robust financial security, so you can trust us to deliver high-quality services with full protection.

Terms and Conditions for Solar Installation Services

1. Introduction

These Terms and Conditions ("Terms") govern the sale, installation, and maintenance of solar photovoltaic (PV) systems by EverBright Solar (referred to as "Company", "we", or "us"). By entering into a contract with us, you ("Customer", "you") agree to be bound by these Terms.

2. Definitions

  • MCS: Microgeneration Certification Scheme. The scheme ensures that products and installers meet high standards for renewable energy systems.

  • HIES: Home Insulation & Energy Systems Quality Assured Contractors Scheme. A consumer protection organization that ensures customers receive quality products and services.

  • Solar PV System: The equipment provided by the Company for generating solar electricity, including panels, inverters, and other necessary materials.

3. Quotations and Proposals

3.1. Any quotation or proposal provided by the Company will be valid for a period of 30 days unless otherwise stated.

3.2. The Company reserves the right to withdraw or amend any quotation or proposal prior to acceptance by the Customer.

3.3. All proposals and pricing are based on a preliminary assessment of your property. If any changes are required due to unforeseen circumstances, the Company will notify the Customer of the additional costs involved.

4. Contract Formation

4.1. A legally binding contract will be formed once both parties have signed the installation agreement.

4.2. By signing the contract, you confirm that you have read, understood, and accepted these Terms.

5. MCS Compliance

5.1. The Company is an MCS certified installer, and all solar PV systems will be installed in accordance with MCS standards.

5.2. MCS certificates will be issued to the Customer upon successful completion of the installation, allowing the Customer to access government incentive schemes like Smart Export Guarantee (SEG).

6. HIES Compliance and Consumer Protection

6.1. The Company is a member of HIES, which provides Customer protection in the event of disputes or issues arising from the installation.

6.2. A HIES Protection Plan will be provided to the Customer, including deposit and stage payment insurance, workmanship guarantees, and access to an independent mediation and arbitration service.

7. Installation Process

7.1. Installation dates will be agreed upon between the Company and the Customer. All reasonable efforts will be made to meet the agreed schedule, but delays due to weather, unforeseen technical difficulties, or third-party factors will not be the responsibility of the Company.

7.2. The Customer must ensure that access to the property is available during the agreed installation dates. Any delays caused by the Customer may result in additional charges.

7.3. The Company will conduct the installation in a professional and safe manner, ensuring compliance with all relevant building regulations and electrical standards.

8. Customer Obligations

8.1. The Customer agrees to provide accurate information about the property and ensure the Company has the necessary access to complete surveys, installation, and any maintenance work.

8.2. The Customer must ensure that the property is structurally capable of supporting the solar PV system.

8.3. The Customer is responsible for obtaining any necessary permissions or permits (e.g., from landlords or local authorities) unless otherwise agreed with the Company.

9. Payment Terms

9.1. A deposit of [percentage or amount] is required upon signing the contract, unless otherwise agreed in writing.

9.2. Full payment must be made within [X] days of installation completion, upon receipt of the final invoice.

9.3. If financing options are selected, the Customer must adhere to the agreed payment plan.

9.4. Late payments may result in interest charges in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.

10. Warranties

10.1. The Company provides a workmanship warranty for a period of [X] years from the date of installation. This covers any faults or defects due to improper installation.

10.2. Solar panels and inverters are covered by manufacturer warranties. These warranties are typically [25] years for solar panels and [10] years for inverters.

10.3. The Company will assist the Customer in making any warranty claims but is not responsible for fulfilling the manufacturer’s warranty obligations.

11. Maintenance and Monitoring

11.1. The Customer is responsible for the ongoing maintenance of the solar PV system unless a maintenance agreement has been signed with the Company.

11.2. Regular maintenance checks are recommended to ensure the system operates efficiently.

12. Cancellation Rights

12.1. In accordance with consumer protection regulations, the Customer has the right to cancel the contract within 14 days of signing without incurring any charges.

12.2. If the Customer cancels after the 14-day cooling-off period and prior to installation, any deposit paid will be forfeited unless the cancellation is due to a breach of contract by the Company.

12.3. Cancellation after the commencement of installation will result in the Customer being liable for the cost of any work already completed and materials used.

13. Liability

13.1. The Company will not be liable for any indirect, special, or consequential losses arising from the installation or performance of the solar PV system.

13.2. The Company’s total liability for any claim arising from the installation or operation of the system will not exceed the contract price.

14. Dispute Resolution

14.1. Any disputes arising from these Terms will be handled in accordance with the HIES dispute resolution process.

14.2. If disputes cannot be resolved through negotiation or mediation, they may be referred to arbitration or a small claims court, as appropriate.

15. Data Protection

15.1. The Company will handle all personal data in accordance with GDPR regulations and will not share the Customer's data with third parties without consent, except for purposes related to the delivery of services.

16. Governing Law

These Terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
